Giveaway (“TomTom One Giveaway”) Rules

1.  Eligibility:  The TomTom One Giveaway is open only to legal residents of the US, 18 years of age or older at the time of the entry.  Employees, officers, directors, agents and representatives of NEC, its parent corporation, affiliates, subsidiaries, advertising and promotional agencies, and redemption, fulfillment and judging agencies having any involvement with the Prize or fulfillment of the TomTom One Giveaway, and their immediate family members and those living in the same household of each, are not eligible to enter.   

2.  Giveaway Period:  The TomTom One Giveaway entry period begins on June 18, 2007 at 10:00am (central) and ends on September 28, 2007 at 2:00pm (central).

3.  How to Enter:  To enter the TomTom One Giveaway complete the entry form found at www.necunified.com/iproadmap  All completed entry forms must be received by NEC on or before 2:00pm (central) on September 28, 2007.  No late entry forms will be accepted.  Participation in the TomTom One Portable Giveaway is expressly conditioned upon acceptance of all Official TomTom One Giveaway Rules and is subject to all applicable laws and regulations.  Void where prohibited. 

4. Prizes:  NEC will select one winner via a random drawing conducted by NEC on September 28, 2007 at 4:00 PM (central).  The winner will receive a TomTom One Portable Navigation Device (the “Prize”).  Approximate retail value of the Prize is US $350.00.  No transfers or cash in lieu of the Prize will be authorized.  However, NEC reserves the right to substitute a prize of equal or greater value.  An attempt will be made to notify the winner by his/her preferred method of contact indicated on the entry form within fifteen (15) days after the drawing.  The winner will be required to execute and return to NEC an Eligibility and Publicity and Liability Release (“Release”). in advance of receiving the Prize.  Failure to return the Release as specified, or a Prize notification returned as undeliverable, may result in the entry being disqualified and an alternate winner being selected.  The Prize will be shipped to the US mailing address indicated by the winner.  Any and all taxes of any kind, fees, insurance and other related costs incurred in conjunction with the Prize are the sole responsibility of the winner.  Limited to one (1) prize per winner.  Odds of winning are dependent upon number of eligible entries received.   
 
5. Publicity:  By entering this TomTom One Giveaway, the winner consents to the use of his/her name, photograph, voice, likeness, videotaped footage, biographical data and/or statements for media, advertising, publicity and/or trade or promotional purposes including announcements without compensation, except where prohibited by law. 

6. Administration:  NEC expressly reserves the right to amend, suspend or cancel this TomTom One Giveaway at any time without prior notice to or consent by participants.  All entries are subject to verification.  Administration of this TomTom Giveaway is at the sole discretion of NEC.  Any questions relating to eligibility, rules, awards or any other questions concerning this TomTom One Giveaway will be resolved at the sole discretion of NEC and the decision will be final.  No requests for exchanges or cash equivalent for the Prize will be considered. 

7.  General:  NEC is not responsible or liable for lost, late, incomplete, misdirected, not received, stolen, mutilated or illegible data or entries and/or technical difficulties of any sort.  If in NEC’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the TomTom One Giveaway, or if technical difficulties compromise the integrity of the TomTom One Giveaway, NEC reserves the right to terminate the TomTom One Giveaway or the affected entries.  Any attempt to deliberately damage the content or operation of this TomTom One Giveaway, including but not limited to, through fraudulent acts is unlawful and subject to legal action by NEC or its agents. 
 
NEC HAS NEITHER MADE NOR SHALL BE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESSED OR IMPLIED, RELATING TO THE TOMTOM ONE GIVEAWAY OR THE PRIZE, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  THE PRIZE IS AWARDED “AS IS”.

BY PARTICIPATING IN THIS TOMTOM ONE GIVEAWAY, YOU RELEASE NEC AND All OF its RESPECTIVE parentS, subsidiaries, affiliates, directors, officers, employees, representatives, agents, and agencies FROM ANY AND ALL LIABILITY WHATSOEVER, AND WAIVE ANY AND ALL CAUSES OF ACTION, RELATED TO ANY CLAIMS, COSTS, INJURIES, LOSSES OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE TOMTOM ONE GIVEAWAY, OR FROM THE USE OR INABILITY TO USE THE PRIZE (INCLUDING WITHOUT LIMITATION, CLAIMS, COSTS, INJURIES, LOSSES AND DAMAGES RELATED TO PERSONAL INJURIES, DEATH, DAMAGE TO OR DESTRUCTION OF PROPERTY AND RIGHTS OF PRIVACY, WHETHER INTENTIONAL OR UNINTENTIONAL) WHETHER UNDER A THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY OR OTHER THEORY.  ALL APPLICABLE LAWS APPLY.
 
8.  Winner List:  For name of the TomTom One Giveaway winner, after September 28, 2007, go to http://www.necunified.com/iproadmap or mail a self-addressed stamped envelope to:  TomTom One Giveaway c/o NEC Unified Solutions, Inc. Attn Greg Downum, 6535 N. State Highway 161, Irving, TX 75039.  Requests must be received by October 22, 2007.
